I have been blogging about this for a long time. In this case, Juan Jose Olague Roman had DUI, DISREGARDED TRAFFIC SIGNAL, NO DRIVER'S LICENSE, NO INSURANCE, CAUSED GREAT BODILY INJURY, LEFT THE SCENE OF AN ACCIDENT, AND DID I MENTION THAT HE WAS DRUNK and then trys to turn into freakin' "Houdini" and disappear.
There are literally hundreds of drivers just like "Juan" in Beaufort County 24/7, that's 24 hours a day, seven days a week.
How many people have to die before Law Enforcement and the courts actually do something about the illegal alien missiles on wheels in Beaufort County?
I would really like to know, how many? What is our tolerance level on this?
Is (10)ten deaths per month acceptable in Beaufort County or is (20)twenty deaths per month. At what level is it okay and at what level is it not okay. Really? What's the number?

UCB, I think I have been born again because I agree with you again!!! DUI is a social crime that can be totally avoided. I know of too many people who were arrested, charged and tried only to be found Not Guilty because of the many tactics Defense Attorneys use to avoid Justice. Like delaying for months or years in the likely event that the arresting officer left for "gainful" employment, the witnesses left or cannot appear. The courts are so swamped they allow this to continue without complaint, this had led to a Domino affect of other problems that are now viewed a seperate. Like the law requiring the LE agencies to publicly notify citizens where and when DUI check points will be or requiring officers to give Miranda warnings to drivers in addition to the warning they sign when they get a license or develop common sense. DUI is a crime that everyone can get passion about, truely innocent people die everyday because others choose to get behind the wheel when they KNOW they are wrong. The State has developed Drug Court and other systems to address certian crimes, how about make a statement South Carolina, create and pass the most strict DUI laws in the US and demand every jurisdiction bring defendants to trial within 6 months and take away the persons driving priveledges until they get through court. I know of many people out there with 2 or 3 DUI's pending and none even have a trial date yet (not because of the cops)and they are still driving. God help the person who hurts one of my family when the eye for an eye rule is not applicable. I will find an eye. MADD is Great but DADS are to be feared.
Sheriffs department set up check points all over the county and if you can't produce a valid license or POI(proof of insurance)your vehicle is impounded until you can. Simple,have it our you don't. Also how about these good for nothing Insurance companies working with Law Enforcement. If somebodies Insurance lapses or is cancelled THEY notify Law enforcement and the plate is placed on a list. I admire Law Enforcement for the job they do and work with them, but when are the bleeding heart lawmakers going to grow a pair?

While I wholeheartedly agree with your position on DUI, this death demonstrates the depth of this issue.
The IDS was unlicensed and uninsured. This goes hand in hand. We have a huge illegal population that the feds allow, condone, and encourage. They all work. They need to drive but can't be licensed and thus no insurance. If we're going to allow them here then make them pass a drivers test and be insured. I'm sure this kid's family will need that help in dealing with hospital and funeral costs.
Where's the manslaughter charge? A kid is dead and I see no charge reflecting that action. This IDS caused the death of a school kid and the best we can due is charge him with DUI and leaving the scene.
I don't blame defense attorneys, in fact I sometimes applaud them for showing me just how weak our laws and their enforcement can be.
This school kids family deserves a heck of a lot more justice than I see the IDS being charged for in this killing.
In todays Island Packet there is an update on this wreck. LE is considering upgrading the charges now that the victim has died. This was a tragic accident caused by a drunk, unlicensed, uninsured driver,but in the article SC Highway Patrol accident investigators say it was a low speed accident and the victim WAS NOT WEARING A SEATBELT. He was ejected from his vehicle through the window.

First thought that came to my mind in this tragedy was people are RARELY ejected when wearing a seat belt. Being ejected causes paralysis, head injuries, severe bodily trauma, and broken bones galore.
None of this changes the stupidity of allowing illegal aliens to drive without any of the normal protections we insist upon in a society, but it was stupid for the deceased young man to operate without a seat belt. While his injuries were a direct cause of the illegal operation by an illegal alien, his death was caused by his own negligence.
You read of accident after accident in the Gazette and every other paper in America of serious and fatal injuries and deaths from people not wearing seat belts. It is a stupid choice IMHO. Likely this young man would be alive and talking with his friends and family about the accident if he just realized for a moment that he was not Superman. The laws of physics are not suspended because you are either 17 or just think you are.
Something must be done about this problem with illegal aliens driving our roads without a license and insurance. Many of them obviously don't know how to drive either. The other thing that burns me up is that they are using our roads, and probably not paying taxes that maintain them!
Simple solution: It is a felony to hire an illegal alien. No excuses.
All the government needs to do is create a database for social security number verification. Not publicly accessible, but when you hire someone, they fill out the I-9 form [still required you know] and you send it in electronically or by mail to the Social Security Administration.
Instantly in the case of electronic information, and within 10 days in the case of mail, you get a verification of citizenship along with a picture of the person. EVERYONE has a social security number. At least those legal to work.
This applies to also contractors you hire at home. Retail transactions are exempt.
'Employers' get the report and then decide if the person they hired can remain employed.
Employers who pay payroll taxes who do not follow the rules get jail time. No exceptions - mandatory. No second chances.
Employers who do not pay payroll taxes [i.e., casual domestics, 1099'd people] get a 25% income tax penalty for 3 years for the first offense and then 50% up to 100% for the second and subsequent offenses. Jail time can be used to deter the scofflaws.
Draconian penalties will stop people from doing it - seeing friends and family bankrupted from taxes will stop hiring the illegals to paint the house.
This solves the illegal immigration problem. The lack of work means they go home. This has been a constant theme through out the history - when illegals have no work they go home.
They're not here to start a family here, or make a home here. They're here to make enough money to take back to their home country and live happily ever after, and at the first sign of trouble, they can bolt. That's why they don't care about our laws, or integrating, or paying taxes or anything that has to do with our country. I agree with Joe. No work, no illegal aliens. I always thought that a stiff fine for anyone who hired an illegal would put a stop to it quick. 10k per illegal alien would make most small business owners think about it twice, and for the most part, it is small businesses hiring illegals.
The problem is that most people don't think it affects them. Heck, using illegal aliens makes construction costs cheaper and the cost of having a nice yard lower, etc. There's no real grass roots movement wanting change because most people don't think it is a problem, and no politician wants to touch the issue for fear of upsetting the hispanic voters.
I am the Uncle Tom equivalent of illegal aliens. I am a legal Hispanic immigrant who came to this country 22 years ago, and illegal immigration upsets me. I had to wait in line for about 4 years before getting a shot, I had to visit the US embassy and be interviewed and answer multiple questionnaires, have a background check done and invest time and money for the right to come here legally. I served this (my new) country in the military, got a college education that I paid for myself, and now pay taxes and obbey all the laws...except for speeding when I'm really in a hurry...I worked my tail off to make something of myself. I've made my home and I started a family here, and it makes me mad when law breakers (illegal aliens) demand the rights that I had to earn when the first thing they did for our country was break the law.

Everytime you buy gasoline you pay state taxes on that gasoline that is used by the state to maintain roads. I'm not saying that undocumented workers(thats the PC term we have to use so as not to offend anyone) should be driving in the first place, much less unlicensed and uninsured, the fact is that they do pay taxes to maintain the roads.

The first thought that came to my mind was how do I explain to my son who was a friend of Josh George and a fellow ROTC student. Whose father died protecting the rights of Americans how this could happen in Bluffton, s.c. My first thought could have been that its a good thing he was not on a bike and therefore could not use a seat belt. Maybe I should have thought about a force field , like in star wars. No , as a simple friend of the deceased I thought--- who killed Josh and why. There are some reasons why this young man is dead but none have to do with stupiity. Maybe Josh should be blamed for not being cautious around areas where illegals live and congregate, like BuckIsland rd. or where his killer was found living with 10 other illegals or for that matter where there enablers have them drinking and working oh wait, that is this whole state and country. Because of the extent of the damage to the vehicles(or lack of damage). I spent over 25 years in the fire service responding to auto accidents and I NEVER saw anyone that was wearing a seatbelt ejected from a vehicle, no matter what speed they were going. It is virtually IMPOSSIBLE to be ejected from a vehicle if you are wearing a seat belt unless that lapbelt cuts you in half.
It's a moot point. Poor Josh is gone and a drunk driver killed him, seat belt or no seat belt.

I have a friend whose daughter was ejected from car while wearing a belt - I taught the daughter - she is now grown, married and a mother. She wasa very tiny girl and when the car started rolling she actually came out of the belt...I know it sounds impossible, but according to her (and I believe her) she was wearing the belt...
Seat belts are not suitable for small children, but it would be better for them in the rear. Another possibility is that the child was lying flat with the seat in an almost prone position. Driver's manuals say that is a no-no for adults, because the body could slip under the belts in a collision.
I too have been involved in transportation and accident investigation for over 40 years. I have seen many strange things occur at scenes, like people engulfed in flames and not able to release seat belts. This is one of the strangest though A story of a young man killed by a drunken illegal and now the big story is that his seat belt might have been the cause. Maybe if the illegal was using a seat belt legaly in Mexico this wouldn't have occured

When I have to look into my sons eyes, who was in Bluffton ROTC together, and try to explainto him that Josh's untimely death by a illegal lawbreaking drunk should be the focus of his story, not if he should have been wearing body armor or a helmet or a seat belt if that illegal was not here in the first place. I was told by the Bluffton police that they routinely issue citations to illegals and just let them go. since 9/11 71000 AMERICANS have been killed here by illegals. Maybe we will be told that it is a law that we all have to wear body armour and helmets along with seat belts because our insurance rates will go up if we are caught without them and that any harm that befalls us is our fault if they are not on. I haven't got the best DMV stories, but I do know that they are big policy followers so it might just be that when the rules were given to the insurance company that they HAD to notify the DMV about insurance cancelazitions, (even if you get a new policy... so remember, if you change companies, it's your responsibility to contact the DMV and let them know before they cancel you tags) they didn't make it a rule that the DMV file or notify anyone about it. So they are doing their job. That's not written into part of their job.
IF one sneaks across the borders of the Country ILLEGALLY, AND gets FRAUDULENT identification, that in itself is reason for imprisonment and deportation. Now then,IF the ILLEGAL individual buys an automobile from a friend or other ILLEGALs, and comes by a tag ILLEGALLY and drives that automobile, he looks just like the other 20,000 people who don't look like fair haired, Greenville guys and girls, he won't be detected until he gets caught doing something wrong, or at a DUI checkpoint, which they used to call License Checks. Who's' to say he has to buy any insurance? His other ILLEGAL bosses or family member could buy it for him. But then again, he just MAY have an ILLEGAL FORGED license in his posession. Then, he most likely doesn't have his fingerprints on file in this Country, if he hasn't been a criminal incarcarated in the US. DMV DOES notify Law Enforcement. When an officer stops a vehicle and runs the tag number through the system it notifies the officer if the tag is valid or suspended and the reason why that tag is suspended.

the tag. They are not required to notify a department that a car is now uninsured, they just cancel the tag and if a cop runs it, they can see why it is not registered anymore.

AMEN....A year and a half ago,my daughter in law was driving home from work at a restaurant in Hilton Head where she was working one evening, and an illegal drunk driver crossed the center line and hit her, causing a head on collision. He then got out of the car at the scene, etc.. She had a pneumothorax (collapsed lung) and was seriously injured and was rushed to Hilton Head Hospital, requiring 2 weeks stay in PCU with two different chest tubes, and almost did not make it. She endured much pain. I took over the care of her 2 year old baby. While in the Emergency Room that night, the man that hit her, was there without a scratch on him and was released to the officer and escorted to the Beaufort County Jail. The police officer promised us that in this case this man would be held without bail as he is a "flight risk". Well, 3 or 4 days later, when they had his arraignment, while my daughter in law was still in the hospital in terrible shape and pain with tubes in her chest to breathe, etc, the judge let this man GO on bail!! Well Guess what?? He NEVER showed up for his court date!! Surprise anyone??? Something is so mighty wrong with this system!! Yes, I agree, HOW many of our law abiding Brothers, Sisters, Mothers, and Fathers will have to be mowed over in their own motor vehicles on our roads by drunks driving illegally before action is truly taken!!! Three years ago, my husbands 21 yr old female cousin and her two younger sisters were going to Wal-mart in Hardeeville. She saw someone broken down on the side of the road and, being who she was, had to stop to help them. Not long after a vehicle came along and hit her. She died instantly. The driver stopped, went back to the scene and a few minutes later got picked up by a van load of people. Maybe it was too dangerous for a young female to stop to help someone. I probably would not have and I am sad to say that. Was he drunk? I don't know. Was he illegal? Well, the vehicle that he ditched had no tags. The guy was never found. So, I would definately say he was illegal. Justice will never be served in this case and her two sisters will have to live with this scene forever. I don't have any suggestions for a solution, I just wanted to add this so people could see how often things like this happen.

I realize our jails are over crowded but they are letting the wrong ones out. the judges release criminals that are flight risk, can't/won't pay or don't have a job and won't get one. The judge jails employed criminals, they lose there jobs, homes,income. I totally believe that violent crimes/criminals whomever they are should be jailed. But lets get this straight if your working, release that idiot and make him/her pay. Don't let them lay up with free room and board. If they don't have a job give them one to pay for their room/board at the jail picking up trash. A few of the detention center people could use the workout keeping track of them. The judges need to be replaced or get out of someone's pocket. Something is wrong at City/County Hall.
